AGREEMENT

Welcome to Printerinks.com (hereinafter "Printerinks," "Company" or "Site"). By using this Site, you agree to be bound by and comply with these terms and conditions ("Terms and Conditions"). You also agree to comply with any guidelines or rules posted on the Site regarding any product or service offered on the Site. All such guidelines and rules posted are hereby incorporated by reference into these Terms and Conditions. Please read them carefully.

COMMUNICATIONS

When you visit PrinterInks, purchase products or services through the Site, or email the Company, you are communicating with us electronically. You consent to receiving communications from us electronically. We will communicate with you via email or by posting notices on and updates to the Site. By using the Site, you hereby agree that all agreements, notices, disclosures and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing. We welcome your feedback about the Site. However, any comments, ideas, notes, messages, suggestions or other communications sent to the Site shall be and remain the exclusive property of the Company, and we may use all such communications in any manner, including reproducing, disclosing and publishing such communications, all without compensation to you.

CONFIRMING, CANCELLING, AND CHANGING YOUR ORDERS

For orders that have already been shipped, you can confirm the date and method of shipment, and obtain an estimated date of arrival by calling our Customer Care Centre at 0870 042 3737 or via email at contactus@printerinks.com. If your order has not yet entered the delivery process, you can change the details by calling the Customer Care Centre. Company will not provide reimbursement for postage and handling charges once the order has entered the delivery process. Refer to delivery link for further details on changing the address after the package has been dispatched.

ORDER AND PAYMENT TERMS

Terms of payment are within Company's sole discretion, and unless otherwise agreed in writing, payment must be received by Company prior to acceptance of an order. Company may accept payment via Visa, MasterCard, Discover and American Express (other forms of payment may be added or removed at Company's sole discretion).

Orders are not binding until the order is accepted by Company. Company expressly conditions its acceptance of your order on your agreement to these Terms and Conditions, Site Terms and the terms of the membership, as applicable.

DELIVERY

Unless otherwise noted, Company will make best efforts to dispatch merchandise within 7 to 10 days of the receipt of a properly completed order, but this is only an estimate. Because of this we have a 15 business day waiting period before any product will be resent. Product availability may be limited and particular products may not be available for immediate delivery, even if the product is not identified as "out of stock" on the Site. Company shall not be liable for any loss, damage, cost or expense related to any delay in dispatch or delivery.

RETURN, REFUNDS, AND EXCHANGED CONDITIONS

If you need to return any product(s) purchased from PrinterInks, you must FIRST obtain a Return Merchandise Authorization (RMA) number by contacting customer service at 0870 042 3737 or by online contact form. RMA # must be requested within 90 days of the order date. Any orders returned without RMA are recycled and do not qualify for any credit.

Customer shall return the products to Printer Inks in the original packaging and enveloped in the original bags or boxes whichever is most appropriate, along with the original invoice or a copy of the original invoice. If no invoice is to be had, please include a letter specifying the problem, and including date of purchase, and the invoice number. Also please include your first and last name, and your phone number. This will help us expedite the solution to your problem, and allow us to contact you if there are any problems, or concerns regarding your return.

Please note that a RMA (Return Merchandise Authorization) is REQUIRED to be included with all returns. In order to obtain this authorization please contact our customer service department.

We accept non-OEM remanufactured or compatible cartridges for return under the following policy. We allow returns for refunds for thirty days from the date of shipment. Unopened product or product that cannot function can be returned up to 90 days. After 90 days from the date of shipment and up to 180 days only unopened cartridges can be returned and will be subject to a 15% restocking fee depending on circumstances relating to specific order. Any cartridges returned outside of this policy will not be accepted for any kind of credit.

We accept OEM cartridges for return under the following policy. Refunds for unopened products will be processed for 15 days from day of shipment. Exchanges will be processed for un-opened product for up to 30 days from the date of shipment. Exchanges will be processed after applying a 15% restocking fee for unopened product between 31 to 90 days from day of shipment depending on circumstances relating to specific order. Because some of our customers have requested new products without returning their defective merchandise, we are unable to dispatch or make refunds/credits until we receive the products being returned. If you need a replacement product right away, we suggest you ask for a refund and place a new order. Your new order will be processed upon payment.

Please allow standard delivery timing of 3-5 business days for your return to arrive in our Returns Department and up to 7 business days to process your return from the time it reaches our Returns Department. Please note that it may take your credit card bank longer to apply the credit to which we have no control over after we submit the data to them, but we do whatever we can to expedite the process.

If you purchase a combo pack and wish to do a return or refund, we the company will divide the price of the combo pack by the number of units included in the combo pack (including free promotional items) to get a per cartridge price. We will then multiply the number of units returned by the unit price previously calculated. If the quantity being returned is less than total combo pack then we will assess a 20% usage fee toward the total refund amount depending on circumstances relating to specific order.

If you wish to exchange a product that you purchased at a promotional price you will be required to pay the difference between the new order and the previous order.

COMPONENT RESALE

Customer shall not engage in the business of reselling components purchased from Printer Inks, or remove components from product for resale, except upon express prior written authorization of Printer Inks.

ASSIGNMENT

Customer may not assign its rights or obligations hereunder without the express prior written consent of Printer Inks.

GOVERNING LAW, JURISDICTION AND COSTS

This agreement is governed by the laws of the UNITED KINGDOM, without regard to its conflict or choice of law provisions. Customer acknowledges and agrees that the UNITED KINGDOM is an appropriate place for venue of any litigation and that UNITED KINGDOM courts have jurisdiction over this agreement and customer. In the event the customer and Printer Inks are unable to resolve any customer dispute, and any collection action, suit or other judicial proceeding is commenced, the prevailing party in any such collection action, suit or judicial proceeding shall be entitled to recover its costs and reasonable attorneys fees incurred.

TAXES

Unless otherwise stated on the face hereof, stated prices include value added duties.

Limited Warranty of Product and Site:

The limited warranty and returns policy provided does not include malfunctions or failures resulting from misuse, abuse, neglect, alteration, problems with electrical power, improper storage, extreme temperatures, acts of nature or improper installation or repairs. Such limited warranty only extends to refunds or replacements of Printerinks Products. You expressly understand and agree that the products and services provided are on an as is and as available basis.

All product specifications, images and other information published on our website have either been made accessible by suppliers, manufacturers, publications, publicists, or been gathered from public-domain sources. The intention of Company is that all the information on the website should be as accurate and up to date as possible. However, Company cannot guarantee the reliability or the accuracy of the information contained within its pages. All the actions taken by the user of the website are the responsibility of the individual.

In the event a product is listed at an incorrect price due to a typographical error or error in pricing information from our suppliers, taxes or duty changes, we shall have the right to refuse or cancel any orders listed at the incorrect price whether or not the order has been confirmed. If your credit card has already been charged and we subsequently cancel your order, we will immediately issue a credit to your credit card account in the value of the incorrect price (including delivery charges).

You accept full responsibility for keeping your account password confidential, restricting access to your computer and keeping the e-mail address associated with your account current. You are personally liable for any orders that you place or charges that you incur. Periodically links may be established from Site to one or more external web sites, these links are provided for your convenience only. None of such links should be deemed to imply that Company endorses the Third Party Sites or any content therein.

TERMS AND CONDITIONS

This sale is subject to the terms and conditions stated herein, which are in lieu of and replace any and all terms and conditions set forth in any documents issued by customer, including, without limitation, purchase orders and specifications. In case of conflict between the terms and conditions stated here and those on the face hereof, those on the face hereof shall control. ANY ADDITIONAL, DIFFERENT OR CONFLICTING TERMS AND CONDITIONS ON ANY SUCH DOCUMENT ISSUED BY CUSTOMER AT ANY TIME ARE HEREBY OBJECTED TO BY Printer Inks, AND ANY SUCH DOCUMENT SHALL BE WHOLLY INAPPLICABLE TO ANY SALE MADE HEREUNDER AND SHALL NOT BE BINDING IN ANY WAY ON Printer Inks.
